Resolution No. 24-50 Intent to Repeal Tax Credit if Income Tax Levy Fails

RESOLUTION NO. 24-50 A RESOLUTION INDICATING DELAWARE CITY COUNCIL’S INTENT TO AMEND SECTION 192.081 OF THE DELAWARE CODIFIED ORDINANCES RELATED TO THE TAX CREDIT PROVIDED TO DELAWARE CITY RESIDENTS. (AS AMENDED)

WHEREAS, this Council has considered various changes to the municipal income tax code; and

WHEREAS, this Council has voted to propose an income tax levy to Delaware residents during the November 5, 2024 general election.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Delaware, State of Ohio that:

SECTION 1: Should the tax levy to be placed on the ballot in the November 5, 2024 general election receive a sufficient number of votes to pass, this Council will adjust the current City of Delaware residential income tax credit for taxable income of City of Delaware residents, which is subject to a municipal income tax in another municipality, from “one-half of any income tax paid or credited to the other municipality” as set forth in Delaware City Code Section 192.081 to “sixty-five percent (65%) of any income tax paid or credited to the other municipality” NOT TO EXCEED 65% OF THE TAXES OWED TO DELAWARE.

SECTION 2. Should the tax levy to be placed on the ballot in the November 5, 2024 general election receive an insufficient number of votes to pass, this Council intends to repeal Delaware City Code Section 192.081, which establishes the City of Delaware residential income tax credit for taxable income of City of Delaware residents that is subject to a municipal income tax in another municipality.

SECTION 3. Any final action of this Council resulting from the exploration of the adjustments identified in Sections 1 and 2 of this Resolution shall be subject to a public hearing and all other requirements of the Delaware Codified Ordinances, Delaware City Charter, and laws of the State of Ohio.

SECTION 4. This Council finds and determines that all formal actions of this Council and any of its committees concerning and relating to the passage of this Resolution were taken in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in those formal actions were in meetings open to the public, all in compliance with the law including Section 121.22 of the Ohio Revised Code. 132

SECTION 5. That this Resolution shall take effect and be in force immediately after its passage.
